The motorization of law into mere decree was not yet the culmination of simplifications and accelerations. New accelerations were produced by market regulations and state control of the economy - with their numerous and transferable authorizations and subauthorizations to various offices, associations and commissions concerned with economic decisions. Thus in Germany, the concept of "directive" appeared next to the concept of "decree." This was "the elastic form of legislation," surpassing the decree in terms of speed and simplicity. Whereas the decree was called a "motorized law," the directive became a "motorized decree." Here independent, purely positivist jurisprudence lost its freedom of maneuver. Law became a means of planning, an administrative act, a directive. ~ Carl Schmitt
Legal Positivism quotes by Carl Schmitt
What I have called the internal morality of law is in this sense a procedural version of natural law, though to avoid misunderstanding the word "procedural" should be assigned a special and expanded sense so that it would include, for example, a substantive accord between official action and enacted law. The term "procedural" is, however, broadly appropriate as indicating that we are concerned, not with the substantive aims of legal rules, but with the ways in which a system of rules for governing human conduct must be constructed and administered if it is to be efficacious and at the same time remain what it purports to be. ~ Lon L. Fuller
Legal Positivism quotes by Lon L. Fuller
The judge punishes lawbreakers as a burning house injures its occupants. A person may be burned to death while robbing a home or saving a friend. Similarly, from a moral point of view, the judge's work is good or evil, depending on whether the laws he enforces are good or evil. ~ Thomas Szasz
Legal Positivism quotes by Thomas Szasz
How did Kirchmann understand the worthlessness of jurisprudence ? The answer lies in the aphorism: "Three revisions by the legislator and whole libraries became wastepaper." With a sharp alteration this answer became a slogan:"A stroke of the legislator's pen and whole libraries became wastepaper." Another aphorism in the same vein made the point even more brusquely and less politely: "Positive law turns the jurist into a worm in rotten wood." Kirchmann meant that jurisprudence could never catch up with legislation. Thus our predicament becomes immediately obvious. What remains of a science reduced to annotating and interpreting constantly changing regulations issued by state agencies presumed to be in the best position to know and articulate their true intent? ~ Carl Schmitt
Legal Positivism quotes by Carl Schmitt
The essence and value of the law lies in its stability and durability (...), in its "relative eternity." Only then does the legislator's self-limitation and the independence of the law-bound judge find an anchor. The experiences of the French Revolution showed how an unleashed pouvoir législatif could generate a legislative orgy. ~ Carl Schmitt
Legal Positivism quotes by Carl Schmitt
Hauriou, became a crown witness for us when he confirmed this connection in 1916, in the midst of WWI: The revolution of 1789 had no other goal than absolute access to the writing of legal statutes and the systematic destruction of customary institutions. It resulted in a state of permanent revolution because the mobility of the writing of laws did not provide for the stability of certain customary institutions, because the forces of change were stronger than the forces of stability. Social and political life in France was completely emptied of institutions and was only able to provisionally maintain itself by sudden jolts spurred by the heightened morality. ~ Carl Schmitt
Legal Positivism quotes by Carl Schmitt
My dream is to reform the legal system over the next 20 years. ~ David Eagleman
Legal Positivism quotes by David Eagleman
70 to 80 percent of country economy is controlled by the Bolivian state, and the other percentage by the private sector. We admit that it's legal, constitutional, that the private sector is entitled to its own economy, but to ensure these profound changes that clearly this government is promoting, including profound changes in the food industry, what we are doing is an important step. ~ Evo Morales
Legal Positivism quotes by Evo Morales
The word criminal is more an emotional than legal term. Go to any U.S. post office and view the faces on the wanted posters. Like Dick Tracy caricatures, they stare out of the black-and-white photographs often taken in late-night booking rooms - unshaved, pig snouted, rodent eyed, hare lipped, reassuring us that human evil is always recognizable and that consequently we will never be its victim. But ~ James Lee Burke
Legal Positivism quotes by James Lee Burke
Creativity is one of the last remaining legal ways of gaining an unfair advantage over the competition. ~ Ed McCabe
Legal Positivism quotes by Ed McCabe
Women living in America in the mid-1800s were the legal property of their husbands. A married woman had no right to property, no right to buy and sell real estate in her own name, no right to bequeath any property whatsoever to an heir. A married woman of the time had no right even to her own children. And, needless to say, she had no right to the vote. ~ Stephen Cope
Legal Positivism quotes by Stephen Cope
The child must depend on the most imperfect mother; the mother may be devoted to the most unworthy children; in such relations legal revenges are vain. ~ G.K. Chesterton
Legal Positivism quotes by G.K. Chesterton
Punishment is justice for the unjust. ~ Saint Augustine
Legal Positivism quotes by Saint Augustine
And Americans realized that native people are still here, that they have a moral standing, a legal standing. ~ Dennis Banks
Legal Positivism quotes by Dennis Banks
Legal behavior is not incompatible with rational, self-interested behavior. ~ Leonid Hurwicz
Legal Positivism quotes by Leonid Hurwicz
... on May 1, 1855, Lucy Stone and Henry Blackwell were married. Before the minister began the ceremony, Henry read the protest which he and Lucy had prepared:

"While acknowledging our mutual affection by publicly assuming the relation of husband and wife, yet in justice to ourselves and a great principle, we deem it a duty to declare this act ... implies no sanction of, nor promise of voluntary obedience to, such of the present laws of marriage as refuse to recognize the wife as an independent, rational being, while they confer upon the husband an injurious and unnatural superiority, investing him with legal powers which no honorable man would exercise, and which no man should possess ~ Miriam Gurko
Legal Positivism quotes by Miriam Gurko
Reasonable doubt trumps everything. ~ Rebecca McNutt
Legal Positivism quotes by Rebecca McNutt
Ten things you should always do when you form a group

1. Work with your friends
2. Find like-minded people
3. Have ultimate self-belief
4. Write great songs
5. Get a great manager
6. Live in Manchester
7. Support each other through thick and thin
8. Realise no one person is bigger than the group (thanks to Gene Simmons for that one)
9. Watch where the money goes
10. Always get separate legal advice for everything before you sign; failing that, ask your mam and dad ~ Peter Hook
Legal Positivism quotes by Peter Hook
Actions that exemplify the limitations of a singular devotion to the profit motive, also draw a troublesome distinction between what is legal and what is moral. ~ Usman W. Chohan
Legal Positivism quotes by Usman W. Chohan
While we think of the boundary between what is legal and what is not as a clear dividing line, it is far from being so. Rather, the boundary becomes further and further indented and folded over time, yielding a jagged and complicated border, rather than a clear straight line. In the end, the law turns out to look like a fractal: no matter how much you zoom in on such a shape, there is always more unevenness, more detail to observe. Any general rule must end up dealing with exceptions, which in turn split into further exceptions and rules, yielding an increasingly complicated, branching structure. ~ Samuel Arbesman
Legal Positivism quotes by Samuel Arbesman
There are millions of people who consume music illegally every month. Just getting them into a legal service will make the music industry way bigger than it's ever been before. ~ Daniel Ek
Legal Positivism quotes by Daniel Ek
As of 2006, there were still fifty-three countries where a husband could not be prosecuted for the rape of his wife. Even in Germany, rape laws were amended only in 1997 to create a legal category of marital rape. ~ Yuval Noah Harari
Legal Positivism quotes by Yuval Noah Harari
But we noted also in all these victoruous worlds a remarkable identity. For instance, in the loosest possible sense, all were communistic; for in all of them the means of production were communally owned, and no individual could control the labor of others for private profit. Again, in a sense all these world-orders were democratic, since the final sanction of policy was world-opinion. But in many cases there was no democratic machinery, no legal channel for the expression of world-opinion. Instead, a highly specialized bureaucracy, or even a world-dictator, might carry out the business of organizing the world's activity with legally absolute power, but under constant supervision by popular will expressed through radio. We were amazed to find that in a truly awakened world even a dictatorship could be in essence democratic. We observed with incredulity situations in which the "absolute" world-government, faced with some exceptionally momentous and doubtful matter of policy, had made urgent appeals for a formal democratic decision, only to receive from all regions the reply, "We cannot advise. You must decide as your professional experience suggests. We will abide by your decision. ~ Olaf Stapledon
Legal Positivism quotes by Olaf Stapledon
A behavior has occurred that is good, bad, or ambiguous. How have cultural factors stretching back to the origins of humans contributed to that behavior? And rustling cattle on a moonless night; or setting aside tending your cassava garden to raid your Amazonian neighbours; or building fortifications; or butchering every man, woman, and child in a village is irrelevant to that question. That's because all these study subjects are pastoralists, agriculturalists, or horticulturalists, lifestyles that emerged only in the last ten thousand to fourteen thousand years, after the domestication of plants and animals. In the context of hominin history stretching back hundreds of thousands of years, being a camel herder or farmer is nearly as newfangled as being a lobbyist advocating for legal rights for robots. For most of history, humans have been hunter-gatherers, a whole different kettle of fish. ~ Robert M. Sapolsky
Legal Positivism quotes by Robert M. Sapolsky
Bad laws are the worst sort of tyranny. ~ Edmund Burke
Legal Positivism quotes by Edmund Burke
We're involved right now in some very significant legal battles and it would be the wrong thing for me to do to step out in the middle of those battles. ~ Bill Scott
Legal Positivism quotes by Bill Scott
I really am not going to get involved in a discussion about the legal position of the Iraq war. I am not the person to do that because I am not sufficiently impartial as a lawyer about this, because it's a matter that is of interest to the person that I am closest to in the world. ~ Cherie Blair
Legal Positivism quotes by Cherie Blair
They all wanted me to sell you out."
There was silence on the line. They both knew that Vlad knew too much about Roman's business dealings - both legal and illegal. He could have made a fucking fortune on selling Roman out.
"Why haven't you?" Roman said, sounding unconcerned, as if he hadn't doubted for a moment that Vlad wouldn't do it.
Vlad scowled and took a gulp of beer.
"Because apparently I'm an idiot. ~ Alessandra Hazard
Legal Positivism quotes by Alessandra Hazard
Any new pathway to citizenship is completely off the table ... [Illegal immigrants should be able to get citizenship] the same way as any other immigrant has to do it ... You have to apply for legal permanent residence, be it family-based or employment-based. You shouldn't be treated worse than the people doing it the right way, but I think it would be unconscionable for us to treat them better than the people who are doing it the right way. ~ Raul Labrador
Legal Positivism quotes by Raul Labrador
Just as TurboTax simplified much of the tax process, so has the colossally scary legal process been reduced to a kinder, gentler series of mouse clicks and 'Continue' buttons by LegalZoom, the online leader that has become so prominent in its market that it's practically a generic. ~ Lynda Resnick
Legal Positivism quotes by Lynda Resnick
We're trying to win the right to vote and we have to focus the attention of the world on that. We can't do that making legal cases. We have to make the case in the court of public opinion. ~ Martin Luther King Jr.
Legal Positivism quotes by Martin Luther King Jr.
As a girl, she was a legal prey, especially if she was dressed in a worn black leather jacket and had pierced eyebrows, tattoos, and zero social status. ~ Stieg Larsson
Legal Positivism quotes by Stieg Larsson
Sodomy will always be a sin with god, even if its legal in Massachusetts. ~ Gordon Klingenschmitt
Legal Positivism quotes by Gordon Klingenschmitt
There may be thunder in Europe but it is in America the lightning will fall ~ Ambrose Bierce
Legal Positivism quotes by Ambrose Bierce
I'm not sure I can say there is a clean line between me as an individual and me as a lawyer. ~ Anita Hill
Legal Positivism quotes by Anita Hill
In the legal world, a sickened worker may be compensated far more than a killed worker. ~ Steven Magee
Legal Positivism quotes by Steven Magee
The only way a society of diverse people can survive without tearing itself apart over differences in nature is by accepting that ALL people are different, and that no single one of us is more or less deserving of decent treatment, compassion, legal and ethical equality, justice, life, or love, than any other. ~ Christina Engela
Legal Positivism quotes by Christina Engela
By characterizing the use of illegal drugs as quasi-legal, state-sanctioned, Saturday afternoon fun, legalizers destabilize the societal norm that drug use is dangerous. They undercut the goals of stopping the initiation of drug use to prevent addiction ... Children entering drug abuse treatment routinely report that they heard that 'pot is medicine' and, therefore, believed it to be good for them. ~ Andrea Barthwell
Legal Positivism quotes by Andrea Barthwell
It's always interesting to see what judges do when their legal philosophy conflicts with their political views. ~ Jeffrey Toobin
Legal Positivism quotes by Jeffrey Toobin
I care so deeply about this matter that I'm willing to take on the legal penalties, to sit in this prison cell, to sacrifice my freedom, in order to show you how deeply I care. Because when you see the depth of my concern, and how civil I am in going about this, you're bound to change your mind about me, to abandon your rigid, unjust position, and to let me help you see the truth of my cause. ~ Mahatma Gandhi
Legal Positivism quotes by Mahatma Gandhi
As a legal and economic instrument, the zone presides over a cocktail of enticements and legal exemptions that are sometimes mixed together with domestic civil laws, sometimes manipulated by business to create international law, and sometimes adopted by the nation in its entirety. Incentives vary in every location but might include: holidays from income or sales taxes, dedicated utilities like electricity or broadband, deregulation of labor laws, prohibition of labor unions and strikes, deregulation of environmental laws, streamlined customs and access to cheap imported or domestic labor, cheap land and foreign ownership of property, exemption from import/export duties, foreign language services, or relaxed licensing requirements. ~ Keller Easterling
Legal Positivism quotes by Keller Easterling
I felt really compromised. I think legal marriage is unnecessary and I would not have formalised the relationship [with husband Peter Davis] except for going into Parliament. I have always railed against it privately. ~ Helen Clark
Legal Positivism quotes by Helen Clark
Denying the poor access to knowledge goes back a long way. The ancient Smriti political and legal system drew up vicious punishments for sudras seeking learning. (In those days, that meant learning the Vedas.) If a sudra listens to the Vedas, said one of these laws, 'his ears are to be filled with molten tin or lac. If he dares to recite the Vedic texts, his body is to be split'. That was the fate of the 'base-born'. The ancients restricted learning on the basis of birth. In a modern polity, where the base-born have votes, the elite act differently. Say all the right things. But deny access. Sometimes, mass pressures force concessions. Bend a little. After a while, it's back to business as usual. As one writer has put it: When the poor get literate and educated, the rich lose their palanquin bearers. ~ P.Sainath
Legal Positivism quotes by P.Sainath
Why should it be illegal to sell something that's perfectly legal to give away? ~ George Carlin
Legal Positivism quotes by George Carlin
As the data from the past decade clarify, there is no evidence that poverty causes crime but a great deal of evidence that crime causes poverty. By aligning themselves against the police, against commonsense tactics like stop and frisk, against metal detectors in public housing, against swift and certain punishment, and for a broad array of legal protections for accused criminals, liberals helped to aggrieve the lives of the poor and society as a whole. ~ Mona Charen
Legal Positivism quotes by Mona Charen
